When Should a Workplace Issue Become a Legal Matter?

Not every workplace disagreement requires legal advice. But when an issue involves pay, dismissal, discrimination, bullying or an employment agreement, it may be time to look beyond an internal solution.

Knowing when to seek legal guidance can help employers and employees understand their position before the issue becomes a formal dispute.

When Is a Workplace Problem More Than Just a Disagreement?

A disagreement at work does not automatically create a legal matter. People can have different views about responsibilities, performance, communication or workplace decisions without a legal issue arising.

The situation can change when the problem involves a legal obligation or could affect someone’s rights under an employment agreement or workplace law.

For example, an employer may need to manage an employee’s performance or consider ending their employment. An employee may have concerns about their pay, treatment at work or the terms of their employment. How these situations are handled can matter just as much as the underlying issue.

This is where employment law becomes relevant. MBA Lawyers advise employers and employees on matters including employment contracts, workplace policies, performance management, disciplinary processes, restructuring, redundancy and termination.

Five Signs a Workplace Issue May Need Legal Attention

Some situations deserve legal attention because the consequences can extend beyond the workplace itself.

1. A termination is being considered

Ending an employment relationship is not simply a matter of telling someone their employment is over. The circumstances surrounding the decision and the process followed can be important.

For employers, this may involve questions about performance management, disciplinary action, redundancy or the terms of an employment contract.

For employees, a dismissal may raise questions about whether the correct process was followed or whether they have grounds to challenge the decision.

2. Money or entitlements are in dispute

A disagreement about wages should not necessarily be treated as a simple payroll problem.

Issues can arise around unpaid wages, employment entitlements, Modern Awards or the terms of an employment agreement. Keeping accurate records of hours worked, payslips, agreements and correspondence can be particularly important if the matter progresses.

3. A workplace complaint involves bullying, harassment or discrimination

Not every difficult interaction is legally considered workplace bullying or discrimination. However, repeated unreasonable behaviour, sexual harassment or discriminatory conduct can raise serious legal concerns.

These matters may require more than an informal conversation, particularly if an internal complaint has already been made or the conduct is continuing.

4. An employee believes they are being treated differently after raising a concern

The timing of workplace decisions can sometimes become important.

For example, an employee may raise a workplace concern and subsequently face disciplinary action, changes to their employment or termination. The circumstances need to be considered carefully rather than assuming that every adverse workplace decision is unlawful.

Issues involving adverse action and general protections can be dealt with through the relevant employment law framework, depending on the facts of the matter.

5. A workplace disagreement is becoming a formal dispute

There is a difference between an issue that can be resolved internally and one that has moved towards a formal legal dispute.

Warning signs may include:

  • A formal complaint or claim has been made
  • A lawyer’s letter has been received
  • An employee has been dismissed and is challenging the decision
  • Negotiations about an employment matter have broken down
  • A dispute involves an employment contract or workplace agreement
  • A matter is being considered before a tribunal, commission or court

At this point, understanding the legal position early can be important because formal processes may involve specific requirements and time limits.

What Should You Do Before a Workplace Issue Escalates?

The first step is usually to establish what has actually happened.

Before making a significant decision, employers may need to review the relevant employment contract, workplace policies, performance records and correspondence. Employees may also benefit from gathering their employment agreement, payslips, relevant communications and records of workplace incidents.

It can also help to separate the facts from assumptions.

For example, an employee who believes they have been treated unfairly may need to establish what decision was made, why it was made and what happened before and after the decision. Similarly, an employer dealing with an underperforming employee should be able to identify the performance concerns and the process followed to address them.

Obtaining advice does not necessarily mean starting court proceedings. In some circumstances, understanding the legal position early can help the parties determine whether the issue can be resolved without formal litigation.

Where a matter has already developed into a dispute, MBA Lawyers also assists with Litigation & Dispute Resolution, including employment related disputes.

When Should You Speak to an Employment Lawyer?

There is no single point at which every workplace problem becomes a legal matter.

However, legal advice may be worth considering when a workplace issue involves employment rights, contractual obligations, significant financial consequences or a formal process such as dismissal, disciplinary action or a claim.

For employers, getting advice before taking a significant employment action can help clarify the legal requirements that apply to the situation.

For employees, advice can help explain their rights and the options available based on the particular circumstances.

MBA Lawyers assists with employment matters across the Gold Coast and Brisbane, including contracts, workplace disputes, performance management, termination, unfair dismissal, general protections, workplace bullying, discrimination and industrial disputes.
