Will preparation
A will prepared by a solicitor is the best way to ensure your estate is divided according to your wishes rather than the fallback statutory rules of intestacy. Home-made wills can result in the executor of your estate applying to the Supreme Court to determine your true intentions at the time of making of your will. Your estate would be reduced by legal costs. In a worst-case scenario, a will prepared incorrectly by yourself would be invalid leaving you with no will and having died intestate.
Enduring Power of Attorney
A Power of Attorney is the legal power to appoint someone to make decisions on your behalf. “Enduring” simply means that the power continues even if the person giving it loses the capacity to make decisions.
Advance Health Directive
An Advance Health Directive allows you to plan what medical treatment or health care you would like in the event that you cannot make decisions for yourself. It also enables you to appoint an attorney for health and personal matters if you want.
You can use your directive to express your wishes in a general way, such as stating that you would want to receive all available treatment.
You can include relevant information about yourself that health professionals should know, such as:
- special health conditions
- allergies to medications
- religious, spiritual or cultural beliefs that could affect your care.
Testamentary Trusts
The key benefits of this type of will, and its difference from a standard type of will offering outright or simple gifts, is that it offers beneficiaries of the will who have reached a ‘preservation age’ (25 years is suggested) the opportunity to choose whether to take their benefits directly and absolutely on the death of the testator, or to have those benefits held in trust for them. A will with an effective testamentary trust offers asset protection and tax effectiveness.
